Las marcas de coches se pusieron de acuerdo entre los años 2006 y 2013, ambos inclusive, para llevar a cabo una inflación del precio de adquisición de los coches por encima del valor real del mercado. Ante ello, la Comisión Nacional del Mercado de Valores y la Comisión Nacional de los Mercados y la Competencia han sancionado a las marcas. Estas han recurrido esa sanción a la Sala de lo Contencioso-Administrativo del Tribunal Supremo de Justicia, confirmándose, por parte de este tribunal, estas sanciones.

Como consecuencia de estas sanciones, las marcas han de devolver a los consumidores unos importes que oscilan entre los 1.000 a 5.000 € por vehículo dependiendo del año de compra, marca y modelo. Para obtener la indemnización es necesario un perito economista que, de acuerdo a los precios del mercado, valora el importe que ha sido inflacionado en el automóvil. El coste de ese informe es de 175 €, y desde Araujo, Viña & Sanfiel Abogados trabajamos con el perito que representa a la Agrupación de Afectados por el Cártel de Coches.

Plazo máximo

Aunque existen criterios dispares respecto del plazo de prescripción para el ejercicio de esta acción conforme a las últimas novedades jurisprudenciales, se recomienda iniciar la reclamación extrajudicial previa al menos antes del día 31/03/2022, sin que ello suponga el inicio de una acción judicial, ya que con la reclamación se interrumpe el plazo de prescripción.
